Terms of Service

The Acaeum, operating through Interserver and Cloudflare, provides web-hosting services to clients all around the world. As such, The Acaeum has the responsibility to protect each client and provide them with the best services available. The following guidelines were designed to insure these services.

By agreeing to accept web hosting services from us, you agree to abide by these Terms of Service.

Content

All web-hosting services provided by The Acaeum may be used for lawful and ethical purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State, or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statute.

The subscriber agrees to indemnify and hold harmless The Acaeum, its operators, and its parent host (Interserver, Inc) from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or links:

Pirated software (warez), videos, or audio files

Hacking tools or any files illictly acquired

Pornography / nudity

The Acaeum will be the sole arbiter as to what constitutes a violation of this provision.

Unlimited Traffic/Hits & Server Resource Usage

The Acaeum is pleased to offer our clients unlimited traffic/hits and server usage. "Unlimited Traffic/Hits" refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the allotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service, the following traffic/usage patterns may cause you to exceed acceptable use:

Programs / scripts running from your domain being used on other domains ("hotlinking")

Sites with immense file / graphic archives or galleries

Sites running large chat room gatherings

Artificial Intelligence Large-Language Models (LLMs) run locally

Sites otherwise using more than 20% of system resources

The Acaeum will be the sole arbiter as to what constitutes a violation of usage limitations. Should you exceed your usage limitations, The Acaeum will notify you via e-mail as a warning. Subsequent violations may result in suspension of your account.

Chat Rooms

The Acaeum allows clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. You are free to install & run your own chat script, as long as it does not hinder server performance.

CRON Jobs

The Acaeum allows CRON Jobs to be conducted on our server. These do need to be manually installed by us, so contact us for further details.

IRC

We currently do not allow IRC (Internet Relay Chat) or IRC bots to be operated on our server, due to system resource usage concerns.

Multiple Connections

Multiple telnet and ftp sessions are allowed, on a single hosting account.

Commercial Advertising - Email

Spamming, or the sending of unsolicited email, is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.

The Acaeum will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as Opt-Out/Removal requests are fully honored. Please make an effort to limit outgoing mail on your account to no more than 5,000 pieces per DAY and no more than 20 pieces per minute. Many times we have seen sites push over 1,000 emails in one instance -- this causes extreme server loads and prevents other people from accessing server services.

Server Abuse

Any attempts to undermine or cause harm to this server, or to use this server to undermine or cause harm to any other server, is strictly prohibited. We will pursue legal action to the fullest extent for all abuse of the Interserver Network.

Suspension / Deactivation

Failure to follow any terms or conditions will result in grounds for account suspension or deactivation. The Acaeum reserves the right to remove any account without prior notice. If The Acaeum deactivates your account for violating policy, your donation will not be returned or prorated to you under any circumstances. Normal policy is a warning first, and account deactivation for the second offense. Serious offenses may cause immediate deactivation, at our discretion.

The Acaeum respects the privacy of every individual who hosts a website with us, visits our website, uses our forums, or sends us e-mail. The only information that we require from you to establish an account is a valid e-mail address. This information will only be used by The Acaeum administrator, and only to contact you. It will not be sold, given, or otherwise distributed to any third party.
