It's complicated and confusing, and I know … I know… a certain someone here is going to pip their little swich and leap out of their chair to furiously type away something…anything… to make his case that he's a truly honest, sincere guy caught up in some tragic happenstance. He was in the wrong place at the wrong time. He felt threatened. He was a VICTIM.
I apologize for taking so long to address this. I felt like it might be better just to let it go after a while, but after more and more annoying posts from Pipswich over the last year after it was detailed who he was, I knew I had to elaborate. And you guys deserve to know your suspicions were correct. I'll post later in more detail on this, but I really just didn't have enough free time over the last year to go back through this big mess.
The basic jist is this: Ebay seller wowart aka Jane Frank of Worlds of Wonder Art demonstrated how bumbling and incompetent she is on several auctions -- and further complicated matters by lying to me. However, COMPOUND that with nefarious Buyer #2 aka Gigimgm aka Pipswich who spied an opportunity to negotiate a sale on a PREVIOUSLY SOLD AUCTION for a painting, along with other screwed-up-by-the-seller auctions.
Unfortunately, as many of you know, Ebay is NOT in the business of being an arbiter or in law enforcement. For most problems in auctions, they just step back and stay out of the fray. That's their policy. And that's why Pip and wowart were allowed to get away with what they did.
And let's be clear on this: this type of stuff of reselling the same painting twice doesn't happen in live auctions. And in a live auction, no one's going to allow a buyer to negotiate on a previously sold auction. But Ebay basically tolerates it, unless they have no wiggle room.
The basic sequence of events is this, in case you want to skip the excrutiating details (and I don't blame you) that I will post later:
By the way, this all happened a year and a half ago.
1. Ebay seller
wowart aka Jane Frank
re-lists previously-unsold paintings with the option of either BINs or BestOfferBINs
2. I purchase three paintings (which I had beeen tracking previously), as I notice them popping back up on a Sunday evening, and receive notification I've won.
3. I select the "request total from seller" link so that the Seller can correct for combined shipping. I further ask about a couple other paintings which hadn't been relisted after failing to sell previously weeks or even a month before.
4. Unbeknownst to me, the Seller, at some point shortly after my winning the third painting, inadvertently re-lists TWO of them. (this will be detailed later)
5. Seller sends me an invoice later that evening with the corrected total for the three paintings and shipping, but waits on my email response for the next day for the ones that I was asking about but had not relisted that evening. (I'd already logged off my email and headed home for the night.)
6.
Buyer #2 aka Gigimgm who later turns out to be Pipswich
meanders along a couple hours later, seeing all the "remaining" paintings, including the two ones erroneously re-listed, and proceeds to "buy" several paintings.
7. Seller notifies both me and Pipswich the next day there's been a mistake with the auctions and that two of the paintings she is now going to sell to him. She doesn't know how this thing could have happened, but I ask her to hold off until I can take a look and see if I can sort this out. She "agrees".
8. In the meantime, I complete the paypal transaction with the modified shipping invoice the seller had sent me for the three auctions.
AND THIS NEXT PART IS REALLY THE ONLY THING YOU NEED TO KNOW:
9. Pipswich demands he be sold those two paintings in particular
PLUS HE NEGOTIATES TO BUY A PAINTING HE COULDN'T BID ON
(my third painting).
10. Pipswich and Seller agree on some lame deal for the now THREE pieces of art I had previously won. Beyond those, Pipswich agrees to buy three other remaining pieces later that day.
11. Seller then calls me to present this plan of action thinking that I'll give my blessing.
HOW DUMB IS THAT?
Check this out: her deal is I give up the three paintings I want, Pipswich gives up nothing (his paintings were never offered and I didn't want those ones anyways) yet gets my three paintings. However, she'll set me up with several other paintings that I don't want, plus one other (that wasn't relisted) that I do want. This way she can make everyone as "happy as possible." Make sense???
12. I figure out what happened in the auction relistings after some research. (again this will be detailed later)
13. I notify the Seller as well as Ebay on what I've learned. Ebay notifies her and she discusses it with Pipswich.
14. Seller doesn't want to admit she accidentally re-listed these, and things quickly become complicated and spiral downward. Around this time, the seller REFUNDS my paypal transaction.
15. I go back and forth with the Seller who eventually gives me a story that she's not selling ANY of my THREE paintings to EITHER of us because she can't make either of us happy. Instead, she "may or may not relist these at a later date" but that she "won't hand them over to the other bidder."
16. I file a Seller non-compliance with Ebay (I'll detail this later) for which she is forced to sell to me one in particular (in Ebay's convoluted mind, it's "free and clear", but the others are not)
17. Seller winds up selling to Pipswich his other auctions PLUS my two paintings, but they decide they're just going to keep that QUIET to themselves.
I considered taking legal action and slowly gathered information that I'd need, but life gets busy, and how much time do you want to spend pursuing a $300 lawsuit? I know he felt emboldened by that to continue on with his lame behavior. However, word has been out for a while on both Frank and Pip, so many artists already know what to expect from them anyways. It's not as if he doesn't lie to artists he's approached already.
Word spreads faster than you know, Pip. Your charade only lasts so long EVEN WITHOUT MY DETAILING IT. I know you think you're pretty smart and there's so many fools to be had, but man, a lot of people on this site have been onto you for a loooooong while.
And yeah, I know you're going to wish you could just chalk this up to a flame war so that you don't have to fess up to your sordid behavior on Ebay and elsewhere.

Wow. Thank you for being so open and clear about these dealings that many had suspicions were going on or intimated at.
I can't say that I will change my view of people as a result of this post or thread as I've made it clear in the past how I thought, but I feel it certainly makes it crystal clear to a lot of people what has been going on.
I'd go back to my posts several months ago about pipswitch, but I'll leave that for people more eloquent and better placed at combatting such crooks than me.

, so as not to detract from the ETC./jonb/lisa thread, pip has clearly lost the plot with convuluted posts, random tangents and utter BS, just so he can play the martyr and protector of the 'wronged'... badly.
Reminds me of a year or so ago, before all posts turned to cake and he left (briefly).
Perhaps he isn't a troll, but The Uber-Troll, playing it cool during re-generation until coming back to take the attention again.
And I thought he'd turned the corner to become a decent chap recently...

Unfortunately with the numbers of ebay sellers out there there are bound to be some screw-ups and you have run into one of them in a big way. Running an ebay auction isn't difficult yet they still feck it up. Given the original post I think the blame should lay firmly with the seller. Your second buyer might have some moral issues to answer but they haven't done anything technically wrong. Again this is based soley on this post. And I might have missed something but that is my tuppence worth.

I've had enough of Pipswich. I did a favor for him by getting him DCC36 (Gencon 2009) but I will do no more favors for him. To many instances of questionable transactions by one individual.

The auctions were set up as immediate payment required. He did not pay immediately as his post above indicates. As such he did not meet the contract terms and they remained listed FOR SALE on ebay.
As such, they remained listed with ebay for sale. I bought them in good faith and met both the contract terms and Ebay terms.
I was subsequently contacted by the seller and told that another former client was upset that he didn't win the auctions. I ended up not getting on of the items Ebay determined that I was supposed to.
This is simple. You didn't pay immediately when the auctions were set up requiring payment.
If you don't have the money to pay for immediate payment required auctions don't cry
foul
when someone beats you to the purchase.
While you were negotiating a better price on shipping, they sold. Too bad for you.
Anyone here is welcome to go try to buy an immediate payment required auction and not pay. You will see the item remains listed for a legitimate buyer who meets the terms of the sale.
Misterspock, I have not had any real issues with you, but you just managed to whine about your own ineptitude. Kudos.

Oh, and the item I won but did not get, was negotiated for his benefit, without even knowing who he was. Jane offered me some other things that I liked just as much and I purchased them instead... so that a stranger might at least get one of the things he/she wanted and so that Jane could try to retain a client.
I was straight up about this and did not post details formerly simply out of respect for Jane, who appeared to be trying to run a business and got caught in a tough spot. She initially didn't understand the immediate payment required issue, herself, but Ebay clarified it.

Oh, and for those keeping track, this happened a year and a half ago.
Misterspock then began lying about the circumstances to his friends which is what began the tirades against me on this site. I weathered them as gracefully as possible, but some of you should be ashamed of yourselves. I openly posted references to this transaction and suggested the angry party contact me and I have spoken several times on the phone to individuals who had heard only his side of the story. I encouraged them to have him contact me directly, as well.
Until today, I did not know who this individual was. He hid behind a cloak of anonymity making false accusations.
There is a reason for that hiding. I have been libeled, slandered and defamed by him in hiding. He did not bring this matter into the open because it was in his own best interest to keep it in hiding and exercise his anger where he could lie about the context of the sales.
Most of you know at least a couple of things about me. When someone lists something I like with immediate payment required or otherwise, I buy and pay on the spot. I then expect the seller to ship the item.
Misterspock, Cease and desist your unwarranted attacks on my character. Ebay/Paypal and the seller all agreed that I met the contract terms and I had no just reason to even trade out for one painting. Pay faster next time and be a good sport when you lose. This was sour grapes that turned into an 18 month assault on my character and name. You should be ashamed.

If those auctions were set up as immediate payment required, then Spock did not win them. Simply clicking the 'buy it' buttons in no way made him the winner. If that is the case, then Pipswich was free & clear to have bought them.

Exactly. And, ebay/paypal and Jane all figured that out while he called her on the phone nonstop for a couple of days pitching a childish fit. She was so upset that I agreed to negotiate out of one that I wanted, and would still buy.
Then, he and a couple of buddies actually did run me off the site, only to continue complaining about me until I came back so I could defend my reputation as best possible.
This was bunk. He didn't pay because he was trying to negotiate a better price or combines shipping.... or come up with the money. So I bought them, fair and square.
And he sits there complaining about a live auction process a year and a half later? It wasn't a live auction. It was ebay fixed price immediate payment required. I had cash on the spot and I spent it.

As I see it, the items were sold to misterspock on the basis that he committed to buying three items.
Then, as I would and I suspect any right thinking individual would, he asked for a combined shipping cost.
I don't see that as being an attempt not to pay or to stall. I would consider 'immediate payment' to be once an invoice is received for multiple items to be shipped. Not as a 'BIN' and pay within seconds of that button being hit.
From the evidence presented, the seller stated that there was an error in her part.
It strikes me that you, pip, have negotiated with the threat of legal action I suspect on an incompetent seller. That would appear to not be the first time and I suspect it won't be the last.
Any chance of dealing with you again in the future is zero, not that you are concerned I am sure.
And it would seem that already you are wheeling out the same old tired arguments of legal issues with sellers and other such pish that frankly shows you squirming and being an underhand snake.
As I stated many, many months ago when we first had cause to fall out, I find you inability to answer direct questions typical of a snake and someone who is out for their own gain and trying to justify their actions in their own mind, when it would seem that the majority clearly see otherwise.
If you left this forum (again) I would like to think that no-one would give you another thought or discuss your actions so you don't feel the 'need' to come back again.
From what I see, this is one step too far and no amount of your long-winded BS posts are going to dig you out of this one.

That is not the Ebay policy and almost everyone here knows it. I bought them in good faith with no knowledge of what may or may not have transpired previously.
As I noted yesterday. I am not a pushover. When I contractually buy something, I expect it delivered.
One question was relevant. I called ebay and asked if I won the items according to the terms of the user agreements. The answer was yes.
An angry potential customer who did not complete the sale is not my concern. I don't know any of what he says is true.
I do know that he has been hiding in the shadows for over a year attacking me anonymously. That speaks for itself. If he were in the right, he would have resolved it at the time. If he were in the right, he would have come forward when invited on the forum. This topic has come up without specific names in the past.
The issue is simple. He didn't buy the objects. He may have contemplated buying them, but he did not commit and complete a transaction. I did.
For the record, if any of you wonder why I am so concerned about false accusations on this site... BINGO, this is it. It is unconscionable that individuals use this site to attack others when they have done nothing wrong.
Should sellers cancel every completed transaction on Ebay because another customer is upset that they did not buy the item fast enough, or bid high enough? That's nonsense.

Jane is not an "incompetent seller" by any means. Greedy Ebay seller for sure here obviously:wink: She at one time had the best collection of TSR artworks PERIOD (and therefore probably the best TSR collection there ever was...). She still owns the best collection of Fantasy artworks PERIOD. Nobody is in a position to push her around as far as the art goes. She's pretty mercenary though,

Also, let it be known that misterspock has one of the best collections I have seen outside of Bretts and my own cache. I know there are some other guys as well but Spock has the goods... I haven't ever known him to be shady, whiny, or anything bad. He's a stand up guy and very honest. He also has a good relationship with many of the artists and I'd imagine anyone would be hard pressed to find someone who had anything negative to say about him. He helped me get a grail of mine even. -note, that may not sound like a big deal but when it comes to art collectors people usually help themselves to your grails... just ask Iljoon Kim

Fair point Malc.
I'll make a final comment from my point of view though, as far as I have seen, when you make a bid or hit the 'BIN', a statement pops up to confirm you are entering a contract commitment to pay for the items.
Yes, you did pay for items but the seller had no right to re-list them and by the evidence shown so far, they admitted to the error.
On that basis, your 'buy' techinically didn't exist as spock was waiting to hear from the seller (quite reasonably) for a combined shipping cost.
I don't wish to get dragged into a war of
your
legal view and how
you
bought the items and how
you
should have been sent them.
But I'm quite sure you will continue with your spurious claims and bunkum about how right you are and the rest of the world is wrong.
