Worst Ebay sale ever!

Man I am dealing with the customer from hell!!  First of all I sell mostly miniatures (out of print, hard to find and some rare ones).  So I get this French dude who buys 8 of my listings for atotal of $92 or so.  So everything is great, he makes me wait 5 or 7 days and then pays for surface mail shipping.

So far so good Right!

Well surface mail shipping takes 30 - 90 days to reach anybody overseas from Canada (more to Ozzy land :) ) and this is well spelled out in each of my listings quite clearly.

After 3 weeks he complains that the items have not arrived and he is worried.  He tells me that he must consider contacting Ebay to start the lost package claim.  I tell him to be patient!

Another week goes by and he opens up a claim with Ebay and paypal about this lost package :?

I tell him to be patient as per out 30-90 days stated in the listing and he tells me:  " No its lost it never takes this long to get a package from overseas, please refund the money"

I fill out the claim forms a few days later and input in a tracking number into Ebay to dispute his bullshit and impatience.

Suddenly the package shows up at French Customs (hours after I fill out the claim by the way) and he tells me that I screwed up and didn't put gift on the customs form and its going to cost him $30  to pay customs off.  Now he wants a refund and wants to send the stuff back to me.

I tell him I did send it as a gift (all my packages are gifts after all) but that's fine after fees and postage the refund will cost him about $28.90 anyway but please send the package back and we can put this to rest forever.

Now he E-mails me and tells me that's not fair he wants to me to accept the package back and send him another invoice for $15.00 and re-fill out the customs form at a lower value so he can avoid the customs fees.

I am at the end with this guy, I really just want to neg him 8 times and tell him to f**k off.  I just do not want to receive 8 negs for something I did not have any fault in.
What to do :?

Even if you do what he wants, what do you think the chances of not receiving negatives is going to be?

I'm not sure how it works in France but in Canada, if a gift is over $60 you can still get charged tax/duty on the portion over $60.  If there is a dispute on the value or type of item or you are charged the wrong amount of tax, then you can file a claim with the post office to fix the mistake.  I would think that France has a similar process instead of returning and resending the package.

be very careful. you are already breaking the law about gifts + buyer deliberately asking you to knowingly break law again to avoid customs fees. minis are never duty free if country import limit exceed. books and printed matter only usually ok no matter what $
best idea to neg sucker if you think no win and report them for asking to break law if you have not incriminated self already + delete this thread asap as cougar or other unfriendlies could now report you to US authorities to have some fun

I would neg him 8 times and tell him to F**k off...but that's just me.  :wink:

What sort of recourse do you have with Ebay/Paypal as the seller?  You did everything you were supposed to and have the proof (tracking number, customs form, etc.) that the items were shipped and received by the seller.  If he negs you, it doesnt seem as if it would be too difficult to get the negs removed.  But I'm not a seller so I will stop before I type something that is completely incorrect.

Either way....hope it works out.  Shit like that is the main reason why I dont bid on overseas auctions.

Personally I wouldn't worry about recieving negs, unless you are constantly getting negs from people, I think it has almost no impact on people buying, and, even this statment has been shown as untrue in the past, people will buy no matter what... Ebays rating system is mostly useless IMHO and most people will buy what they want to buy and think that bad things will only happen to others and not to themselves... and everyone gets the odd idiot buyer/seller at some stage on ebay..



Ok... as an overseas buyer I think I have been hit with customs on a couple of times (I think if the declared value in Australia is over $500 then customs is paid) and when I have had a bill I've sworn and paid it.. Thats just another factor you have to put up with when you are overseas. I get some ebayers that put down 'Gifts" all the time:),  and some that explicitly say that they will declare on the customs form the true value of every thing that is sent... both are fine, as long as the thing reaches me.. The laws of another country are of no concern to you and whatever you have placed on the form, either "gift" or "real value" is what it is, he now needs to pay whatever he needs to pay and if he has a problem he needs to take it up with the customs people not you, I personally wouldn't change a customs form after the thing has been posted as you are making a declariation in the first place and it seem foolish to "reconsider" what the items are valued at just to save him $15 ($30 customs less the poastage to send it back? plus the postage back to him again I'm assuming) Of course he is going to pay for tracking back to you?

yes they are a concern smuggling laws still exist. if use gift on form to circumvent customs without being asked that is illegal by sender not recipient

I ship out a lot to Canada. I feel for your situation.

But, I want to make it clear to you, nearly 80% of my customers from CANADA, do request undervaluation, and know all the tticks in the book.

They have been so bold, as to say:

I do not want UPS, or USPS Global Express Mail, because they will tax me.

They have gone on to try to request me making it a gift, I refuse to do so.

They go on to say to claim it as $15-$20, no more, but I refuse to do so, if they have spent more.

They go on to even tell me to NOT put any paperwork inside the box or parcel, no notes, no eBay business cards, nada nda..

You have some very BOLD Canadians requesting all these various ways to fool customs. I'm sure that I am not the only seller on eBay that has run into these bold customers. I don't have detailed specirics about selling internationally, I just list my shipping prices internationally to multiple countries. I shouldn't have to make a disclaimer as a reputable seller, that I will not lie on customs form. To me, that demotes my professional image. But, it's always the Canadian customers that buy every item first, and then have this big list of requests, like no invoices, no paperwork, no personal notes, and oh yes, the last one was, can you handwrite my address on the box so that it looks like it's a personal package and not from a business.....and I'm choosing not to use UPS or global express because I will be forced to pay customs/duty taxes.

I agree the legialation should probably change, but there has to be some education about Canadian Customers on eBay, that might open up more listings to Canadian customers. I totally understand why that seller said, "I stopped shipping to Canada." They bombard you with requests which cause us, as U.S. citizens, to contemplate committing a felony.

Thanks for the comments guys. :) I agree with most suggestions, I think i will sit on it a few days and then load him up with negs. 8)

I will not re-send this package again :evil:

Already put him on the no bid list.

Anyway, I shut down my listings for the holidays (do not need the aggravation of long lines) and I may re-evaluate even selling on Ebay.  Sometimes it is just not worth the aggravation.

What is his ebay login? Just want to protect me against him :)

Normally, there is no taxes on imported merchandise as soon as it is not new. Since it is a new product, factory sealed, the limit is 23€. You pay taxes if customs are estimating that value is over (in France customs have autority to make an estimation on every thing...)

Under NO CIRCUMSTANCE should you send him something marked as Gift. I do it for Acaeum members and buyers I know and trust. That's it. It is illegal, and you are opening yourself up to a world of hurt if he spouts off and you get caught.

I have never been asked to mark something as a gift, and now I realize what a gift that is.  I've been lucky, I guess.  It would be nice to know his id, as lokiwookie suggests - and list it in the "Idiot Bidders" thread.  Obviously, he is in the wrong - just depends how much energy you want to put into prevailing.

This is EXACTLY why I refuse to ship to most overseas buyers.  If someone overseas wants to buy my stuff they better be Acaeum members or have a great feedback reputation where I can tell they're frequent buyers of game collectibles and are fully aware of the how and why of everything.

 With ONE exception I've only had problems with overseas buyers.  Mostly they've been in France and Spain, occasionally England.  I've shipped to Canada and Australia numerous times and have never had an issue.  Germany, Israel, and South Africa are usually OK as well.  Oh, I mailed to mention Brazil and Puerto Reco ~ I'll never ship to either of those again!


 Suck up the negative feedback ~ everyone runs into an evil minded or criminally stupid person now and then...  I've found that by actually leaving Negative Feedback during such difficult communications sends a clear message that I'm done messing around and negotiations and efforts (on my part) to make the situation satisfactory on both ends ARE OVER!

BTW, I never ship as a gift unless it is a gift.  Practice sound and legal business policies and you'll avoid lots of stress.  Why stress yourself out to help someone else save a few bucks.  I put it right in my billing statement "I will not mark package as a gift or sample.  You are responsible for duty and/or tax."

One last thing... If a package is ever lost and it is insured (as all international shipments are) all you as the seller must do is provide the tracking information to the recipient.  THEY are the ones who file a claim and THEY are the ones whom the post will issue compensation to.  You as the shipper are COMPLETELY out of the loop and can NEVER receive compensation from the post for a lost package.  After all, you're only shipping someones property to them.  They already bought it and own it.  If it gets lost, they are due the compensation for their lost property.

I've shipped hundreds and hundreds of packages overseas with very little problem. I would say that I ONLY ship global priority anymore and never by other methods...that way I can be assured it will arrive as quick as possible without any delays, and I can charge flat rates that takes the guesswork out of figuring out postage.  Also, this is anecdotal, but I believe global priority packages are treated better than other forms of overseas mail...they seem to arrive undamaged about 99.9 percent of the time..plus you can track them.  The only exceptions are a single paperback I typically ship first class international, but then if it's lost I'm only out $10 or less to refund the money.
