They only time I have ever run into this type of issue was on Amazon when I attempted to purchase a copy of the Delta Green rules.  They didnt have it in stock and kept emailing me once a month for three months until finally they said that they couldnt get it in stock and would be refunding my money.

With that said...Ebay isnt Amazon.  If you put something up for sale and then tell the person that bought it that you dont have it in stock, you shouldnt be selling on Ebay, you should be selling on Amazon.

Dedicated to customer satisfaction?  You obviously werent satisfied.  Smooth?  Not really.  They did refund your payment so that is a good thing.  But now they want to end the transaction amicably.  Their description states they only leave negative feedback when negative feedback is left for them in a way they believe is unfair.  So you should be able to leave neutral feedback and not get blasted with negative feedback in return.  I dont see how they can place an unpaid strike against you though.  I would send an email to Ebay and ask them if they can actually do that.  If the jerk responds with negative feedback I would think you would be able to get it removed.

It would appear that not all the reshippers mentioned in the eBay store thread have disappeared.

I tried to get the same book from Amazon and it turned out to be un-available as well.  The big difference in my mind was I never got charged anything since the book never shipped.

I won't be leaving any feedback but they will not be getting their seller fees back.  I just thought it was insulting that they would even attempt to recover fees.

Or, have them removed from eBay for fraud. If only they had not refunded you...

Somehow I don't think ebay cares that a seller of this size lists phantom inventory.  Looking at their Feedbacks it looks like they make at least 1000 sales per month so they generate lots of revenue for ebay.  Look at the huge negative and neutral feedback numbers.  Ebay is looking the other way.  I should have been more aware of who I was buying from.
