Cougarrinard strikes again

Hello all. I discovered all the chat about David after googling his seller I.d.
So my story in brief. I bid for a 2nd edition dm screen to almost complete my collection and it was advertised in vgc. No one else went for it so £6.99 I was very pleased. Considering the buy now is £33.39. When I received it though it was a state not able to hold itself up and worn to white card in most places. He said send it back and I'll send another bit when he got it back he refunded me.
So I did not go through a returns process because it was an exchange. I nfb him after my refund and refundof return postage. Then he goes nuts and has the nfb removed by eBay. Now he is gunning for my profile! Calling me a liar. Said he hasn't received the return. Etc etc. In this age of social networking surely there's something we can do about it.
I'm letting fb gaming groups know about his rep as much as possible.
Oh and he has admitted that auction sales are of sub quality item's even though he is using the same stock picture as the buy now therefore misleading buyers. I have an open eBay case I can't escalate till August 14th.
Any advice from you all is welcome!

did you ship it back with any tracking? Do you have the receipt for the shipment at least?

did you pay with paypal funds or by credit card through paypal?

was all the communication through ebay?

You can file the complaint through ebay and scan a copy of your shipping receipt to them. Also reference his messages through ebay.
edit: Missed the part above where you mentioned you opened the case against him. Maybe when it escalates is when you show proof of shipment?

Or you can file the complaint through your credit card company if you bought it through paypal that way.

But the OP said he got a refund. And then left negative feedback.

Despite Dave's rep that sounds a little harsh.

The nfb related to item not as described. At all. I did that because he admitted auction sales are for sub quality items and yet the picture used is identical to the buy now item at 5x the price. Therefor misleading me, the buyer. Is this unfair? He also said he would send a replacement in vgc but instead refunded..
I have proof of delivery yes.

Wow - If he didn't mention the quality difference between BIN and auction in the item's description, then I agree with you.  By simply refunding you the money rather than sending you the item that you actually won (as he said he would), he's essentially reneging on his gamble to perhaps drive the auction higher than his BIN.  I have never left nfb because most of the errors that I've run into were honest mistakes, but that's very poor salesmanship, and deserves nfb imo.

When you opened the case with eBay, did you let them know about what he told you (I'm assuming that was through eBay's messaging service)?

. Sorry I can't put the url in cos I'm on my phone.no mention of condition on the buy now. If the auction went high maybe he would have sent a vgc item. He should have anyway. That's what I won and did not recieve.I relish the fight ahead. I'm warning gaming groups I know of on social media.

I agree that the situation sounds unfair and a neutral feedback with low marks for misleading and bad service would be my call since a refund was given. In any case my experience is that you won't be able to neg a seller that refunded your money on ebay. It is  either bad feedback and low ratings or a refund, ebay doesn't seem to let you do both.

If the money was paid through a service like paypal then it would be marked as refunded on ebay whether then item was marked returned or not.
