Well. That seems to show that spock won the items without any doubt.

Maybe pip did buy them too via an incompetent seller or underhand back door trading.

Either way, he forced a sale through that he had no right to wing. As I stated, no doubt he forced the seller with threats of legal action, libal, slander, BS, ebay coming round and eating her children.

Hell will freeze over before pip has once ounce of respect or decency it would seem.

Seems that bc, kosh and others were making a good judgement call from the start...  8)

Now, where's my dragon cake gone...

It appears your primary issue is with Jane or Ebay.  If the items were listed and "sold" more than once, they are the arbiters of the decision.  Ebay confirmed to me that I had won and paid, fair and square.  And, it appears that you bought the things one day and paid the next so they remained listed in the interim?  Or did they get relisted by Ebay or Jane due to a non payment glitch and I simply paid before you did with Ebay taking my side.

In any event, when I buy something on Ebay and pay, I expect it delivered.  I don't expect the vendor or a buyer who had not paid to stake a claim to the items I won.  Nor do I expect to be accused of doing something wrong when I simply buy things in good faith.

Since this episode predates my joining the site, so no wonder I found such a warm welcome.  Perhaps had I joined sooner we could have resolved something more amicable at the time.

I am sorry if ebay glitched or even if Jane did.  I simply confirmed ebay/paypal policy and proceeded to go about my business of collecting.  Too bad that you chose to wait a year and a half to bring it up with me.

What I am sorry for is for participating in negotiations after the fact for the other pieces.  I didn't like the negotiations much then, and I like them even less now after hearing your side of the story.  I was under the impression from Ebay that I had no reason to relinquish anything I bought, but that two days? of negotiations were resulting in all three parties leaving happy.  That clearly didn't happen and I wish that it had.

I am glad you got Lycanthropy and I hope you got a couple of other nice things in the negotiations that I assume we were both party to?  I know I didn't get everything I was willing to buy and I assume that means you got some of them, both previously listed and not.  Meanwhile I got Fairie Circle, Paladin in Hell and some others.  Too bad we couldn't both get everything we wanted, but there were only one of each of these.

Glad you got some of what you wanted!
Glad I got some of what I wanted too!
Ain't life complicated, lol.

I hope you sleep better for getting this off your chest.  I don't actually hold grudges well, so if we both get to gencon sometime I will buy you a drink.  I'll duck if you swing.

As I have said before, anyone who has an issue with a transaction you believe me to be party to is welcome to contact me to discuss it.  Preferably, in a timely manner.   Most of the time things can be resolved more easily than this, for sure.

oh I suspect spock has more to show yet. However, pips 'oh well, you DID win them, but I got them cos I pushed harder' attitude still sucks.
Tone of his posts change when he is shown up like that...  Another example of 'bad luck, I'm alright Jack' eh?
Guess pips never wrong in life, justifying his actions to himself til he's convinced he's right and a stand up citizen. Once again though that tone of threat comes through "went about my business of collecting". Threat of legal more like. What a joke.

Pipswich wrote:The auctions were set up as immediate payment required.  He did not pay immediately as his post above indicates.  As such he did not meet the contract terms and they remained listed FOR SALE on ebay.

As such, they remained listed with ebay for sale.  I bought them in good faith and met both the contract terms and Ebay terms.

I was subsequently contacted by the seller and told that another former client was upset that he didn't win the auctions.  I ended up not getting on of the items Ebay determined that I was supposed to.

This is simple.  You didn't pay immediately when the auctions were set up requiring payment.

If you don't have the money to pay for immediate payment required auctions don't cry foul when someone beats you to the purchase.

While you were negotiating a better price on shipping, they sold.  Too bad for you.

Anyone here is welcome to go try to buy an immediate payment required auction and not pay.  You will see the item remains listed for a legitimate buyer who meets the terms of the sale.

Misterspock, I have not had any real issues with you, but you just managed to whine about your own ineptitude.  Kudos.

Pipswich wrote:Oh, and for those keeping track, this happened a year and a half ago.

Misterspock then began lying about the circumstances to his friends which is what began the tirades against me on this site.  I weathered them as gracefully as possible, but some of you should be ashamed of yourselves.  I openly posted references to this transaction and suggested the angry party contact me and I have spoken several times on the phone to individuals who had heard only his side of the story.  I encouraged them to have him contact me directly, as well.

Until today, I did not know who this individual was.  He hid behind a cloak of anonymity making false accusations.

There is a reason for that hiding.  I have been libeled, slandered and defamed by him in hiding.  He did not bring this matter into the open because it was in his own best interest to keep it in hiding and exercise his anger where he could lie about the context of the sales.

Most of you know at least a couple of things about me.  When someone lists something I like with immediate payment required or otherwise, I buy and pay on the spot.  I then expect the seller to ship the item.

Misterspock, Cease and desist your unwarranted attacks on my character.  Ebay/Paypal and the seller all agreed that I met the contract terms and I had no just reason to even trade out for one painting.  Pay faster next time and be a good sport when you lose.  This was sour grapes that turned into an 18 month assault on my character and name.  You should be ashamed.

Just thought I bring these posts in light of current newer information.

I missed this post originally.  I really hope you aren't actually trying to claim what I think you're trying to claim here.

Nope, you are.  Jesus Christ another swing and a miss.  Let me set the record straight, this is pretty much the 1st that I've (and likely anyone outside of perhaps Tharizdun) heard of any of this.  Misterspock had like a grand total 30-35 posts here prior to your join date and not a single solitary one reference this issue here.  As a matter of fact from the date the auctions ended(August 31, 2008)  to your join date here(November 5th, 2008) he had all of 13 posts, none of which even came close to alluding to this topic.

So know your reception here had everything to do with your own actions HERE on this forum and nothing else prior to it.

Sorry.

Pip - You can't really take the moral high ground here. You've already shown yourself to be morally bankrupt in another thread, and expressed your inability to do the right thing, when it does not directly benefit Pip. It would appear that you have an uncanny ability to carry out spuriously organised and unethical transactions. I don't know whether the people you find are already corrupt, easily corrupted, or just downright stupid (certainly in Lisa's case the seller is already corrupt, in this case it would appear she has been corrupted), but you seem to have no problem abandoning your moral and ethical highground when you personally can profit from such corruption.

So Pip, where is your evidence to refute Mr. Spock's assertion of your wrongdoing? Oh, that's right. You have none.

Your behavior plus Spock's evidence damns you. Case closed.

As fun as it is to watch it go on and on like this, it needs to come to an end.  (Eventually.  Take your time, it's good entertainment.)  But I think the various parties involved need to stop and think about what they hope to accomplish by extending the argument.

Are you looking for an apology? An admission of guilt?  Just want to take someone down a peg?  Hoping a warm fuzzy feeling will wash over us all?  Trying to run someone off the site?  Just like arguing?  Trying to save face?  Just using the argument thread to shill Lemurchat limited edition t-shirts?  What?

I think they're trying to establish a correlation to the similar incident below:

'...Meanwhile, another report blames it on the husband and wife playing Dungeons and Dragons since the eighties...

An Alabama professor accused of fatally shooting three colleagues last week had previously admitted in court to punching a woman in a tirade over a booster seat at a Massachusetts restaurant.

Citing a police report, WBZ-AM and The Boston Globe both reported Tuesday that Amy Bishop was charged with assault after the incident in 2002 at the International House of Pancakes in Peabody.

The police report says Bishop became incensed when she found out the other woman had received the restaurant's last booster seat. Bishop hit the woman and shouted multiple times, "I am Dr. Amy Bishop," the report says.'

'...When Bishop arrived with her family and was told there were no more booster seats, the report says, she became "very angry and loud and stated that, 'We were here first.'"
The victim told officers that Bishop, then working as a Harvard researcher, came to her table and launched into an abusive, profanity-laced tirade. The woman was at IHOP with her two young children, whose ages are not listed on the report.
Bishop was so irate that the restaurant manager came over to try to calm her down.
"She continued to shout and at one point exclaimed loudly, 'I am Dr. Amy Bishop!" the report says.
When the manager asked Bishop to leave, it says, she punched the other mother in the right side of the head. Bonaiuto said the manager wrote down Bishop's license plate number as she was driving away...'

The above is quoted from two different news blogs, but there are a few more details if we want to parse out the blame. Dr. Bishop claimed she & her family were at the restaurant first to wait for a table, but the other family was seated first, thereby giving them (the other family) the first chance to ask for the last remaining booster seat. The media's conclusion: blame D&D.

The evidence is in the ownership.  And, in his own Ebay correspondence listed which showed I had already paid when he had not.  And, in the fact that he worked out a side deal with Jane for additional works as a remedy.

Even to me it looks like they shouldn't have been listed again unless there was a glitch in Ebay's immediate payment required system.  However, I completed contract terms first and also spent two days negotiating the purchase anyway.  All the while aware that another angry party was involved but expecting that access to the previously unavailable works was providing an adequate remedy for any issues.

Note that misterspock's payment for the negotiated items I believe he bought (since she didn't just turn around and sell them to me) indicates legal completion of the transaction and agreement to its terms.  If he were not happy at the time, he should not have completed/settled a transaction with Jane and pursued other options then.  Once he negotiated an alternate purchase and completed the transaction the matter of who bought what legally ended.  Now, a year and a half later, and at some points, in between, I am simply being defamed along with Jane because he settled a matter in a way he didn't like?  I don't think anyone here is confused about the amount of anger that must be represented in stewing on this for 18 months... and addressing this matter in this manner.  Sorry the guy is angry, but he has not handled this properly.

Too bad it didn't work out better for all involved.  Sometimes life is like that.  There are not always conspiracies or malintent.  Accidents and crappy things happen in life.

Go back to gnawing my bones though.  They sure must be tasty for a few of you.  lol.

Yeah. Look at the amount of people who have died in Lisa/Jonb/ETC's last six years on eBay. All during their months on eBay but not during their absences. Presumably they should have learnt that when they sell on eBay things start killing their family members. Do you think they sell D&D in order to kill their family? Or do you think when their family gets ill they sell D&D in order to pay for life saving medications and when we all don't pay enough their families die anyways?

At least some of the members here (well one at least) feels sorry for them and is simpathetic of their plight. All I can do is hope the rest of the family dies off quickly so we are spared more of the same.

In light of all the death and struggling in this woman's life, how cruel is it that Pip decided to open a case with PayPal and leave negative feedback. That's just evil and two faced considering what he's already said about her. Build her up on these forums and then stab her in the back in private. That's real shitty.
