Would've been nice to have recognized their name but yes, agreed in /that/ context.

@gro': detached pages are pretty much "as new" for 1sts & 2nds and 1st GHs but missing pages and water damage are another matter. Well, it's in Capital One's hands for now:  I sent them a 2 page letter and about 20 pages of documentation (who knows how that'll turn out via fax, but I also gave them the URL for the pics, offered high-res pics, etc.).  

Even if Capital One doesn't side with me, for some unfathomable reason, I should still have time to get the dispute opened with PayPal/eBay, I think.  Hopefully that won't be an issue, of course!

That seller was horrible.

I cannot see how anyone with ANY sense of fairness could possibly side with the seller here.

If your credit card company try to worm out of it on a technicality, I'd be going to the police or taking out a private prosecution against the guy for fraud. Maybe this guy needs someone close to him to go visit him and have a chat.

Update:  things are now resolved in my favor from Visa/Capital One's standpoint as of the 15th of October.  The seller failed to provide any documentation or evidence within 45 days as part of Visa's dispute process, and they basically forfeited their position within the dispute process.  So, the chargeback from Visa credited to my account back at the end of August is now permanent, and cannot be reversed through further action by the seller.

So that's all of the good (actually, no, excellent!) news....

The strange news is that when I shipped the box back at the end of August, the seller refused the shipment.  So, I still have the woodgrain set on my shelf, in the UPS Store packed box.  He's refused to send me any money to send the box to him again, or to pay to have UPS pick it up from my home (or for my first attempt to send it back, too), so it'll sit there until he does, for now.  

The irksome news is that the seller has supposedly filed charges against me with his local police station and the IWCC/FBI.  Given that I haven't done anything wrong, and have documented this entire process very thoroughly, I'm not really worried about this, but I'd much rather that this whole saga would be over and done with, rather than have another chapter to deal with.

C'est la vie:  I'm very pleased with the refunded dispute outcome from Visa, so I'm not really letting this get under my skin :D

If anyone here ever has to go through this process in the future, I can certainly help you from my POV and experience!

I'm glad it is more or less resolved at least financially.  Is it a worthwhile thing for you to contact the authorities and find out if such a case has actually been filed and to send them your documentation as well or will they eventually contact you?

I would be curious to know how the police deal with such a case - which seems like a complete waste of their time and how they deal with the seller who after reviewing the evidence would most likely be the one responsible for fraud.

I would wait for the seller to pay the cost of shipping now too (or for the police to take it into evidence).  You've done a more than reasonable amout to get it back to the seller.  Let it be up to him now to be responsible in getting a hold of you and reclaiming the set.

I guess the question I have left is did the seller keep the payment from Paypal or are they going to attempt to take the money back?

I paid for the auction with my Visa, via Paypal.  So, as far as I understand it from Visa, there's no further recourse from the Paypal/eBay side of things.  I'll be contacting them later in the week to validate that, and to give them details about the seller's behavior/issues as well:  I suppose its unlikely that they would attempt to remove him preemptively (since I didn't raise the issue/dispute with them), but you never know.  He's certainly not someone I or anyone else should consider buying from.

At some point, it may become abandoned property and there is likely a process you can pursue to claim ownership.  He sounds like he is mishandling the heck out of the situation.

I'm pretty sure your part in the matter is done.  But I wonder what happened on his end.  When you paid, Paypal gave him the funds.  Paypal may have put a hold on them until delivery but at some point he has probably had access to do what he wants with them.  I'm not sure how long it takes or what happens to Paypal when you make a chargeback (and take the money away from Paypal).  Paypal should then go after and recoup from the seller but if he has spent the money, etc.

Something tells me that if this mortard didn't get his money from Paypal he might be more active in getting his item back.

I bet he has the money and is sitting on a dispute on his end with paypal. him not receiving the item back from you only helps his case... until it's made obvious that he refused it and you have the item waiting.

Your done... but you may want to contact his PD to let them know your side and that you have the (refused) item in question if they want to send for it.

The fact this dude refused shipment on the item completely blows whatever standing he might have had.  I can guess his case is going to be he sent you a box in the shape he described, and you substituted a worse copy (which is why he refused shipment, he'll say; he wasn't getting his copy back but a beat up duplicate) and tried to rip him off that way. Tough titty for him though.

I wouldn't contact his police dept; it's an absolute waste of time. He's probably just filed a report with his local PD which would help him if he needs a paper trail to try and get his money back somehow (insurance claim perhaps?). He doesn't have an officer working his case; it's just a file tucked in a folder somewhere until eternity.  If you know how police depts work, they  have zero interest in having anything to do with this case.  I've heard of houses getting burglarized to the tune of thousands of dollars and the local PD not even making a trip out to the house to write a report. Believe me you would be wasting time; if they want to contact you, let them do it, that's there problem not yours.  OH, and if you get a call purporting to be from the police in this matter, ask them for their PD's number and their extension and call them back; it could be the guy or his buddies just messing with you.
