What it boils down to is courtesy. If that happened to me, and I was the second bidder, I would have let Spock have them, or at LEAST e-mailed him and figured out a solution that would make everyone happy, if possible.
Things didn't used to be this way. Our niche used to be a friendly one.

While I don't have enough info just yet to make a determination on what really happened, I'd be hard pressed to think that Misterspock would not know/get confused as to whether or not the auction was closed or not.   Additionally, we also have a known quantity here, i.e:

Pipswich wrote:The auctions were set up as immediate payment required.  He did not pay immediately as his post above indicates.  As such he did not meet the contract terms and they remained listed FOR SALE on ebay.

As such, they remained listed with ebay for sale.  I bought them in good faith and met both the contract terms and Ebay terms.

I was subsequently contacted by the seller and told that another former client was upset that he didn't win the auctions.  I ended up not getting on of the items Ebay determined that I was supposed to.

Was this kind of like the same thing back several months ago when you talked a seller into closing a running auction auction that already had bids on it?  You remember, I'm sure, I know I do.  If you don't, I'm sure that I can dig it up.

ETA:  Aww, what the heck, I'll do it anyway:

Pipswich wrote:Oh, and for those keeping track, this happened a year and a half ago.

Perhaps you can explain why the amount of time passed actually matters, rather than trying to dismiss what's been said out hand. If you're not lying like you're so adamant about(again), then how ever long ago it happened shouldn't matter.  Unless of course, you're again not being honest(which would just continue the trend) and then your motives for trying to deflect attention from it by the length of time it took to come to light would be clear as day.  Hmmmm....

Pipswich wrote:There is a reason for that hiding.  I have been libeled, slandered and defamed by him in hiding.  He did not bring this matter into the open because it was in his own best interest to keep it in hiding and exercise his anger where he could lie about the context of the sales.

Again the length of time should have nothing to do with it, if you're telling the truth.

Pipswich wrote:Most of you know at least a couple of things about me.
I'm assuming that you wrote this just for the lulz.

This type of plea might actually mean something from someone who has a little less shady, dishonest and self-serving past as yourself, that's pretty much known to everyone who posts here regularly.

I mean you really could not have been serious when you posted this, right?

But please be willing to let this rest after a while.  Neither of you will give much ground in this argument, so the back-and-forth only proves who is more stubborn.

And, the drama continues.

Enjoy feeding on my bones for a while.  I know its a favorite hobby for a few of you.

If misterspock had a leg to stand on, then or now, the items would have been shipped to him at the time.  He has never contacted me directly about this either.  Classy guy.

Anyone with half a brain can read between the lines.  I am buying enough illustration to aggravate him.  Enough said.

Wait, assuming what he is saying is true, explain again why he would owe you such a favor?

I have no idea what he has in mind of proving his claim, however according to his accusation(again assuming it's true), you screwed him over royally and now you expect him to treat you with some sort of respect by keeping it private?

Seriously?

Yeah, that's definitely it.  This sounds vaguely familiar as a matter of fact.  Kind of like you try to paint me with the exact same thing this time last year, which was not even close to the truth after I busted you.  It was just you trying to play the victim in the face of overwhelming evidence, so you'll have to excuse me if I am a little more than skeptical at this claim.

I am eagerly awaiting to see how this all plays out.

Real quick, I will address the issues on the specifics with Ebay for the purchasing, shipping and the BINs and stuff, but I don't want to inundate you guys with the minutiae -- yet  :)

In fact, I was thinking about making a giant post in a timeline, but it'll bore some of you to death, right off-the-bat. I do want to post some juicy morsels first, and then later I'll follow up with the in-depth description of what happened on Ebay. Actually, I'm not sure how long of a post I can make with the image attachments, so I'll probably have to break this up, anyways.

Suffice it to say the way Pip describes the situation about myself  and what transpired is pure and simple fantasy. Forget what he said for now (ie, with the shipping and payment nonsense ), or come back to it after I post the email notifications and exchanges, and you'll see he just makes up stuff out of thin air. There was no fit or furious phone calls, it's all just him trying to rationalize his bad behavior.

I just want to point out what kind of person we're really dealing with here. So you'll be able to make the call, especially after all his inane posts over the past year.

Also, before this first tidbit I post, I want to reiterate that there were two separate problems here:
1. the Seller's mistake and her later cover-up, and
2. Pip's negotiating on a sold item, outside of any erroneous re-listing

I don't blame Pip for the first part, as that was the seller and her user error. I absolutely have a beef with her mistake after mistake and then lies. However, both she and he did make their secret little deal afterwards.

But I want you to keep in mind the SECOND PROBLEM while you read my further posts. Being quick thinking in his conniving way, he realized there was a problem immediately and jumped to capitalize on it by negotiating on a sold piece that had no Ebay "issue".

You have to wonder what kind of person thinks of doing what I'm about to show you. Take a look back at his posts on how he comments on criminal behavior.

I'll elaborate on this. Imagine we're at a convention, and the auctioneer begins the selling process. Each item placed into the auction gets a UNIQUE number which is placed on an information sheet and that sheet gets placed into a pile "to be auctioned", similar to listing on Ebay. So the auctioneer starts with the first item and the corresponding information sheet and proceeds to complete a sale on it. That information sheet with that specific auction number and the price then gets placed in a "sold" pile. The auctioneer continues on the process with the remaining items, except in this case two of the sold auction sheets are accidentally placed back in to the "to be auctioned" pile and consequently given new UNIQUE auction numbers (THIS IS KEY). Some buyer then walks in late, sees these two auctions and proceeds to "win" these auction numbers. THIS IS WHAT TRANSPIRED.

But now, let's take this the step further. The buyer of the bogus auctions then walks to the back to have a private conversation with the auctioneer in order to negotiate on another piece sold prior to his walking in. THIS IS WHAT ALSO TRANSPIRED.

And we can go steps further in this example as the auctioneer claims the first sales don't count, that he'll see if he can force a way in which he can do a deal, etc. We can go on and on.

Of course, Miss I'm-Going-To-Sing-Like-A-Canary can't help her enthusiasm at this new art deal in which she's the center of, she begins corresponding with me. This was the FIRST message to me that there was a problem. BEFORE anyone had any clue about what actually happened … and as she wildly grasps at theories … look at what Pip is up to!

(And fyi, I'm blurring out any of her or my personal information on any of these notifications.)

Image

Yes, believe it or not, Pip wasn't just asking about it, he was staking a claim to it! And the seller is just happy to oblige her new buddy. EVEN AFTER I paid for all the items, he STILL claimed the third one that he literally COULDN'T purchase through Paypal.
Then, in a later email, he is forced to "stand down" from his claim!

And, yes, I paid for all the items, as I was only waiting on her adjustment of the shipping cost so that I wouldn't be triple charged. The stuff that Pip threw out about negotiating on cheaper shipping or whatever was all nonsense he made up. I had asked her what others she had left and when she as going to post them. I'll post the exchange in the next "chapter".

Of course, Pip would never attempt this devious negotiation at Gen Con. Only with the anonymity of Ebay is this possible. And it sheds a lot of light on how he conducts himself. I never thought I'd be tag-teamed by the super villain buddies.

But I know you all are wondering about this alleged "glitch" on Ebay. Pip also did a BestOfferBIN on a separate painting, which never got relisted and was never available for me or any other one to bid on.  My auctions ended, and then later, new ones of two of them were created with different unique auction numbers. This is why we were both "allowed" to pay for the same two items. Again, Pip just spews out red herrings. I'll print out all the emails in the next chapter.

And how would I be so sure that this wasn't a glitch, you might ask?
And remember her words above  "It's got to be rare, never happened to me before".

BECAUSE THE NUMSKULL DID THE SAME THING TWO WEEKS BEFOREHAND!

There is nothing inconsistent here from my end.  I bought some items and paid for them immediately.

I got a call asking if I would back out of some purchases for someone else who was angry (you apparently) that they didn't get what they wanted.

I said no, which is my right.

Ultimately, after a couple of days of negotiating in good faith, (for things I had already bought and paid for) I think I yielded one (or two) the other party wanted very badly and got some others I hadn't known about.  It appeared to be a challenging but amicable solution to Jane's dilemma with a good standing customer on the one hand and a new one who had ebay support for what I bought.

Does that last bit of August 24th stuff have anything to do with me?  That looks like before I got involved in buying any of them?

And, BC is right, you don't owe me a thing; courtesy, a phone call or benefit of the doubt.  Yet, all I did was buy what I want on Ebay and try to negotiate an amicable solution with Jane.

Do note that from my perspective, you were staking a claim to items I had paid for and that Ebay confirmed I won.  It was not a good situation.

I fail to see why I am not supposed to make a best offer on an item you didn't know about?

It looks like Jane confused the listing process for a while and tried to resolve these matters as best she could when no party was going to be entirely happy with the end results.

I hope you at least got some of what you wanted!

You're not good at reading, I can see. That's why I'll elaborate further in the next chapter.

Like I said, you have no qualms in negotiating on a sold painting. That's why several months back you were nervous someone was going to try to do to you what you did to me. That's how you think, and people know it.

You can make up whatever lies you want and attempt to appear as this angelic bastion of truth and purity on all manners criminal (only YOU believe what you write), but the folks on here know what's going on. And I'm just giving them some evidence.

What I see is that you didn't pay.  And, you continued to try to buy the items out from under me and force me into a negotiation for items I had won.

I negotiated in good faith for additional works, which is my right.  You had not paid for anything and didn't apparently know about others I was buying.  Was Jane not supposed to ask if you intended to pay when you were angry, had not yet paid, and she had a potential buyer in the wings?

You assumed since some of this had not sold the previous week that you could negotiate the price down.  Then I stepped in and bought them and offered to buy a lot more to boot.  You didn't expect a new buyer to step into "your" field.  Sour grapes.  Complete your purchases next time instead of pitching a fit for being slow and getting pinned.

Interesting that pip still avoids answers but just states his own 'facts' to convince himself. Reminds me of a Harry Enfield politician character who would state "no, no it's not" in the face of insurmountable truth.
Interesting emails, spock, just adds to the evidence it seems...
Oh, and its interesting that the 1st email states closed at the bottom to spock, where the 2nd is active. That suggests to me it never was immediate payment.
Also, wowart lives in VA too and types in upper case..Not a relative of jonb et al?

Where do you come up with this stuff? It's because you're paranoid and like to create "scenarios".

Pipswich wrote:I negotiated in good faith for additional works, which is my right.  You had not paid for anything and didn't apparently know about others I was buying.

Who cares what others you were buying? I certainly didn't. Like I said, you don't read too well. I was using your BestOfferBIN as an example that there was no glitch on my auctions because it would've happened with yours.

Pipswich wrote:Was Jane not supposed to ask if you intended to pay when you were angry, had not yet paid, and she had a potential buyer in the wings?

Again, you have no shortage of BS.

I get it, you're putting things on me that YOU do. I think that's called "transference". I didn't negotiate anything down...didn't need to. You wish that I did. I'm an honest buyer, you're not.

Pipswich wrote:Complete your purchases next time instead of pitching a fit for being slow and getting pinned.

Your story's getting shakier by the minute, dude.

Correct, never immediate payment required. They were different auctions with separate unique numbers. Ebay had no idea that she was (inadvertently) putting up new auctions with the same original painting.
