misterspock makes no mention of them being immediate payment. From the evidence he shows, they were BIN with the 'request total from seller' link available.

Whats the point of having an immediate payment necessary, if you have to request a total from the seller. You can't pay until you get that. On that basis, a sale could go to multiple buyers.

That suggests that they weren't immediate payment auctions or that the eby sale model is flawed. But as I said, ebay states you are entering a contract to buy when you click BIN or make a bid. That contract is now pointless as the seller can deal with whomever at a later date.

I don't want to get drawn into an online battle of this, as previous information shown on other threads has shown dubious transactions taking place in the past by pip and this, for me, is a final nail.

That's just my take on it, I think it stinks and it isn't the first time questions have been raised on his buying practices.

That is correct.  But there is no way to verify who is telling the truth about anything at this point since you cant go back and look at the auction listings before purchase to confirm that it was a BIN with "immediate payment required" option.

What I dont understand is why this wasnt brought to light a year and a half ago if there was a problem?  Why wait so long to bring it up and for what purpose other than to smear Pipswich?  Not that I have anything against that if is rightly deserved.  I'd rather wear a steak suit around a group of starving pit bulls than do business with Pip.

Its been awhile since I used a BIN with the "immediate payment required" option.  But I believe that you can opt not to pay immediately even after clicking the "Buy It Now" button.  However, I dont believe that the items will show up in your "Items Won" list if you dont pay for them, so how would you "request total from seller" if you didnt win them???

I reckon that Pips a straight up kind of guy - just read all his previous posts (oh, except the ones he changed that one time). 8O  :roll:

While there is obviously a lot going on here that we're not all seeing I would say that I wouldn't trust Pip as far as I could throw him - nothing terribly personal just a bad feeling got from reading all his posts on this site, nothing more or less.

And add that to the fact that there is a  thread here called "MrSpock is the man of the year" or some similar title then I think you can make a judgement call at least on the personalities of the individuals concerned.

All the BIN stuff and contract/blah/legalese/blah/ebay/blah stuff is one thing - and frankly I couldn't care less about who is right/wrong in this, but another thing, and one far more important on these boards (lest it become , as Malcolm so rightly pointed out, like Dragonsfoot) is that you can still come across as a complete tosser even if you are right.

As I recall, when you win an immediate payment required auction, you are sent to Paypal as soon as you click to confirm the purchase.  I think it would be obvious to Spock that the item was not won if he had cancelled from Paypal, and I don't think ebay would send out an item won email unless it was completed including payment (or if it was not an immediate payment auction).

Whether it was an immediate payment auction or not looks to be the critical disputed fact in this conflict.

Actually, yes. An immediate payment auction forward us directly to paypal and you have to pay immediatly. You cannot ask anything else. If you won an item, you can't do anything else but pay for it. If you don't pay, you don't win them, and you even cannot ask for combine shipping at all.
A BIN, with immediat payment option, you won and then you can ask for shipping infos and the items are added to your items won. You really won them.
If he has been able to ask for shipping, he has won litteraly them. If he hasn't been able, he didn't win them.
That's all.
At least, that is always how ebay works for me when I bid... on each auction I won (BIN, Immediate payment, or auction)

PS: I do not take part in this thread, I only give my experience with ebay payment

exactly my point, when spock hit BIN, they weren't immediate pay auctions. Maybe they were re-listed as such, so pip bought them.
That doesnt mean he had the right to force the sale, no doubt using the lengthy prose we've seen in emails throughout the boards sent to sellers, intimating legal action and BS. If spock was asking for a combined ship and pip bangs the seller with legal ebay shite, no wonder she sold them to him.
As I said, it all stinks and there is a line to draw.
