I'll get cracking on building my case this afternoon or tonight, and I'll definitely start with my credit card company.

Allan, with the above comments,  please don't allow the time to slip by before going for refunds etc.. I made that mistake getting put off and put off by a seller throughout last year, until he stopped replying, stopped selling and ignored the emails.

Ebay didn't want to know, nor did Paypal as the git had made sure the cut off period had passed, despite all his 'nice' emails saying he was going to sort it out.

I put that down to bad experience and now there is no second chance as far as I am concerned.

Anywho, following recent deals on here with lawrenson, killjoy and gyg, I'd go private any day of the week now and am looking to ditch ebay almost completely  :wink:

Most credit cards allow you to make a claim through them within 90 days. Some will let you make a claim whenever. Your credit card company is obligated to ensure that what you buy on your credit card is as described. The burden of proof may be yours, but the obligation to provide a refund, or the legal means to fight the case in the courts is wholely theres.

So go down the PayPal claim route, be patient, and if it doesn't work out with PayPal, chargebeck on the credit card. PayPal may well require that you return the goods to the seller, and if they do, then do so with proof of delivery, full insurance, and take photographs of the item as it was delivered to you, as you package it well, and as you address it. That way, you have proof that you took every care to ensure the item was returned in the condition it was received and he can't counter claim damaged in the mail.

Had a situation back in the Summer of '08 where I was the seller.  Sold an item to a buyer in the middle east and supposedly it was received damaged.

The buyer waited quite a long time (like 2 weeks to a month) to file a dispute through PayPal as eBay wanted nothing to do with it.  So, in my defense I used whatever supported selling success stories I had dealing with my international sales - PayPal really didn't care.  

It was initially decided that with the buyer shipping the item back would receive a refund. WELL - a tracking number was posted (in PayPal dispute resolution) soon afterwards.

So, I check out the tracking number and it can't be found. Additionally, the buyer's eBay member ID suddenly disappears as no longer registered (so maybe they can buy thru a sibling, or has two accounts in two countries, or a scammer on the other end?).  Either way, I contact PayPal about these issues - they said: "well, we'll investigate."  In under two weeks, PayPal closes the case with the statement that NO REFUND IS TO BE ISSUED (in my favor).

Although it's different from yours, it's a view on how PayPal and eBay deal with these things.  The item I sold was quite a bit less than your winning bid and it was processed at the US Post Office as described  truthfully by me (not damaged)

There's also a police station in the seller's hometown.  

A report of fraud can be filed...no idea if it would stick...but it can be filed.

Thanks again guys:  I read through the eBay/Paypal SNAD details earlier in the week, and called my credit card (Capital One) yesterday to see how thing would work on their end.  They explained their process, opened the dispute, and I'll have a full credit back to my account on Monday.  They said the burden of proof (and not just "I said so") is on the seller and I will have plenty of opportunity to bury him with stats and paperwork, so I'm good-to-go, I think.

Excellent news, Grodog!  Glad to hear the credit card company is taking care of customer service.  This is the main reason, I only pay for Ebay auctions using Paypal funded by my credit card.  If I were to use funds in the Paypal account, then I would only have Ebay/Paypal to help out.  In the case of payment made via bank debit, I am not so sure if the bank would be willing to way in on an issue like this.  Does anyone have experience with this kind of claim, Paypal payment with bank debit of funds?  Will the bank help?

Hey, that's great news.
Good CC companies need to be promoted too (some have more red tape than others), so good for Capital One.

Once his disappointment dies down, the seller is sure to regroup and try again. He'll think, "Hey, it worked once; and not everybody will know how to dispute a charge."

We should be on the alert for this item and ready to spam him with questions if it shows up again. In fact, given his attitude and dishonesty, he needs to be honored with a Shady Dealer tag.

Doubtless you are right, Xaxaxe.

However, I think the seller probably didn't expect the meticulous response of a real collector.  

It is possible he just didn't pay enough attention and was surprised when Grodog didn't value the item as much as he did.  I think he was indignant and therefore foolish.

But I wasn't real wild about the whole "no, no, no" thing when the actual answers were clearly "yes, yes, yes."

That landed right on my Dishonesty Radar. Which is next to my Asshat DRADIS.

From what I read; It is not nearly over yet.
Allan has been re-imbursed by his CC Company.
Thats it.
Still must follow through with Paypal and E-Bay.
Plus neg the seller as well, if for no other reason than to warn off the next potential buyer.

The seller will no doubt re-list the set and supplements too.
So, some other poor buyer is going to go through this same sort of crap from the seller that Allan is dealing with now.
The same lame azzed TINY pics and the same lies from questions asked.
I doubt the seller even revises the listing a bit.
At least the members of this forum will be warry, though I am willing to bet that some here will bid on the listing.

My understanding is that Capital One will contact pepsigalore and work the issue with them; I will have the opportunity to provide documentation, etc. to support my dispute, as well the seller, I suppose.  They will decide who keeps the money, I imagine.  

I haven't worked through the Paypal/eBay side at all at this point, since it sounded per Paypal's policies, they would just close a dispute on their end since I had already opened one with Capital One.

My hunch is that the seller will break the set up, and relist the 1st GH separately, since "That book by itself is worth all that you paid and I am sure when I relist it on Ebay, I will have no trouble selling it."  

So, for reference, I'll be making some scans of the worst-offending pages and will post them to my site, in case folks want to see what they look like later.  I'll also post my "% marked-up" analysis of the page counts when they're done too:  caveat emptor indeed! :roll:

Anyway, I'll keep everyone posted on the drama as it proceeds.[/b]
